Psilocybin law in Peru

Psilocybin and psilocin are on Lista IB of Peru's controlled-substance annex, whose production, trade and use are prohibited. We found no reported prosecution of a psilocybin retreat, but also too little evidence of psilocybin retreats operating openly to call the practice tolerated: insufficient evidence.
Psilocybin is a controlled substance with no lawful route for retreats or personal use. Some of these states fund research or trials. A summary of published sources, not legal advice.

- DIGEMID's catalogue of Annex 2 to the Reglamento de Estupefacientes, Psicotropicos (Decreto Supremo 023-2001-SA) lists PSILOCIBINA and PSILOCINA in Lista IB1, and quotes the decree: "Queda prohibida la produccion, fabricacion, exportacion, importacion, comercio y uso de las sustancias de la Lista IA y IB del Anexo N.o 2". - Open operation of psilocybin retreats in Peru is thin. On 2026-10-04 Retreat Guru's Peru mushroom page showed 2 retreats, and the psilocybin offers found were sessions inside multi-medicine programmes (for example Entheogens Peru Soul Sanctuary in the Sacred Valley, alongside huachuma, ayahuasca and other plants). BookRetreats' 'Psilocybin Retreats in Cusco' page listed no Cusco retreat that names psilocybin. Its only mushroom retreats were in Ecuador. - Police do act against psilocybin mushroom sellers: in May 2024 the PNP dismantled 'Los Pitufos del Callao', which grew Psilocybe cubensis in a Callao laboratory and sold it in Lima. - Reason for exclusion: insufficient evidence. Condition 2 (multiple operators openly advertising psilocybin retreats) is not established; the material found is a handful of multi-medicine programmes on booking sites, not an open psilocybin retreat market.
